Subletting a social rented home became a criminal offence in 2013. This means that it’s illegal to move out of your tenancy address and rent your entire L&Q home to others.

The team recently uncovered a case where an L&Q tenant, who jointly owned two other properties, was subletting his entire L&Q property. He charged the person renting his home £1,000 per month whilst living at one of his owned properties.
After a full investigation, the case progressed to court. The Judge gave L&Q permission to take back the two-bedroom property and ordered the L&Q tenant to pay us costs totalling over £7,000.
This year, the Tenancy Fraud team recovered over 50 properties and obtained court orders to try and recover more than £100,000 of illegal profit from unlawful tenants.
Subletting is a serious offence and we will consider taking action against any tenant where illegal subletting of a social rented home is proven. If prosecuted, offenders could lose their homes, incur a fine of up to £50,000 or even face time in prison.

The Prevention of Social Housing Fraud Act is in place for several reasons, including helping landlords provide homes to those that need them most.
